RASTAH TUTORING CONTRACT
THE PARTIES. This Tutoring Contract (“Rastah Tutoring Contract”) made on August 22nd, 2025 is by and between:
Tutor: SHEREEN SHAHID, with a mailing address of 1167 CHOPIN ST, TROY, MICHIGAN 48083 (“Tutor”).
&
Client: The undersigned parent/guardian of a student enrolled in Rastah Tutoring (“Client”).
The Tutor and the Client are each referred to herein as a “Party” and collectively as the “Parties.”
STUDENT.
Tutoring services under this Contract are provided to the enrolled student (“Student”). If the Client is a parent or guardian, the Client affirms that they are paying on behalf of their child and that they are the parent or legal guardian of the Student. If the Client is also the Student, the Client affirms that they are enrolling themselves in Rastah Tutoring and are responsible for payment of services.
SERVICES. The Tutor agrees to provide tutoring services to the Student in the following subject areas:
The Tutor agrees to provide tutoring services to the Student through Rastah Tutoring’s college preparation program. This program will run for approximately six (6) weeks and is designed for high school students. Services will focus on college readiness, including but not limited to: guidance on the college application process, instruction and feedback on college essay writing, and related academic and organizational skills to support the student's success.LOCATION. Tutoring will take place
☐ - In Person. Tutoring sessions will take place in person, and the Student and the Tutor will meet at the following location: 3179 LIVERNOIS RD, TROY, MI 48083 (TROY COMMUNITY CENTER). Sessions will not be rescheduled, and no virtual tutoring option will be provided. If a Student is unable to attend a session, the Tutor will provide the session’s materials and relevant information by email or other electronic communication; however, direct one-on-one tutoring or makeup instruction will not be offered for missed sessions.
SCHEDULE. The Tutor will provide services to the Student:
☐ - On a Fixed Schedule. Each week, the Tutor will meet with the Student at the times below:
SUNDAY
September 14th, 2025
10 a.m. - 11:30 a.m.
NOTE: This course has been intentionally scheduled to avoid all state and federal holidays. Sessions will take place during the fall semester to support students with college applications and other academic preparation. As such, no sessions are expected to fall on holidays, and the program schedule will proceed without interruption unless otherwise communicated by the Tutor.
TERM. This Agreement begins with the 1st Session on September 14th, 2025 and continue for (6 Weeks):
☐ - Fixed Period and continue until [October 19th, 2025] (6 Weeks).
Hereinafter known as the “Term.”
FEES. The Client agrees to pay a total program tuition of $375 for the 6-week course. Tuition is due in full prior to the first session. No installment payments are allowed.
CANCELLATION POLICY. Enrollment in Rastah Tutoring’s 6-week program reserves a dedicated seat for the Student and is therefore considered a commitment for the full term. Once the program begins, no cancellations or refunds will be permitted.
REFUND & PAYMENT ENFORCEMENT. All tuition payments are non-refundable once the program begins. If payment is not received by the agreed date(s), Rastah Tutoring reserves the right to suspend and pursue all legal remedies for collection.
LATENESS. All sessions in this 6-week program will begin and end at the scheduled times. If a Student arrives late, the session will still conclude at the scheduled end time, and no additional instruction time will be provided. Because this program follows a fixed group schedule, the Tutor is under no obligation to provide makeup instruction for late arrivals. If a Student misses an entire session, materials will be shared electronically for independent review; however, the Client remains responsible for full program tuition regardless of attendance.
If the Tutor arrives late to a scheduled session, the Client may choose to add the missed time to a future session at no additional cost or receive a partial credit toward a future session.
It is the responsibility of the Student to review all materials provided electronically for any missed session. The Tutor will not be obligated to provide individual instruction to cover missed material.
TUTOR OBLIGATIONS. The Tutor agrees to provide tutoring services that meet or exceed the industry standards of tutoring for the Student’s age and educational level. The Tutor must maintain an understanding of the curriculum and expectations for the subject areas listed in Section III. The Tutor is required to treat the Student with courtesy and professionalism, to behave during sessions in a manner suitable for the age of the Student, and to inform the Client if the Tutor possesses a good faith belief that there are issues unknown to the Client that may be hindering the Student’s performance in the subject areas listed in Section III.
CLIENT OBLIGATIONS. The Client agrees to ensure that the Student is adequately prepared for each session, including having all books, materials, instructions, or other items necessary for tutoring services to be effective. The Client must explain to the Tutor things that are outside of the subject areas addressed in Section III but which are necessary for tutoring services to be effective, including how to use any educational technology or learning management systems that the Student requires. The Client will make every effort to communicate with the Tutor about alterations to the agreed on schedule with as much notice as possible.
NO WARRANTY. The Tutor, Rastah Tutoring, makes no guarantees regarding results in terms of the Student’s grades, test scores, or performance on any project, assignment, or class. Furthermore, participation in Rastah Tutoring does not guarantee admission into any college or university, nor does it ensure acceptance into any particular program or opportunity. While the Tutor will provide guidance, instruction, and support, ultimate outcomes depend on the Student’s own effort, performance, and the independent admissions decisions of schools and institutions.
MISCELLANEOUS. The Tutor and the Client agree to the following:
Independent Contractor. It is agreed that the Tutor will be considered an independent contractor for the purposes of this Contract, that they will maintain their own independent business and furthermore will use their own tools and equipment in fulfilling the Contract.
Taxes. Any taxes due as part of the Tutor providing their Services in this Contract are the sole responsibility of the Tutor.
Additional Services. Any additional services (“Additional Services”) must be requested by the Client in writing and must be agreed to by the Tutor. Should a request for Additional Services be accepted, the Client agrees to pay for any and all fees charged by the Tutor for such.
Damage to Equipment. The Client will be responsible for any damage or loss to any of the Tutor’s equipment due to misuse or theft by the Student.
Liability and Indemnification. The Tutor will not be liable for direct, indirect, incidental, or consequential damages (including, but not limited to, declining grades) with respect to any claim related to this Contract and the Services provided. The Client indemnifies and holds harmless the Tutor and any subcontractors working with the Tutor against all liability related to the tutoring. The Client will assume all legal fees claimed by third persons, provided that such loss or damage was not caused by the fault or negligence of the Tutor or its employees, agents, or subcontractors.
Additional Liability and Indemnification. The Client acknowledges that tutoring sessions will be conducted in a classroom environment, and the Tutor is not responsible for personal injury, property damage, or loss incurred during participation, except where caused by the Tutor’s gross negligence or willful misconduct.
Force Majeure (Acts Beyond Control). If sessions are cancelled due to circumstances beyond the Tutor’s control (included but not limited to natural disasters, public health closures, or facility unavailability), the Tutor will make reasonable efforts to reschedule. No refunds will be issued but equivalent services may be provided at the Tutor’s discretion.
SEVERABILITY. Should any provision of this Agreement be determined to be void, invalid, unenforceable, or illegal for whatever reason, such provision(s) shall be null and void; provided, however, that the remaining provisions of this Agreement shall be unaffected thereby and shall continue to be valid and enforceable.
GOVERNING LAW. This Contract shall be construed and governed in accordance with the laws located in the State of Michigan where the tutoring services are taking place.
ENTIRE CONTRACT. This Contract constitutes the entire Contract between the Parties. No modification or amendment of this Contract shall be effective unless in writing and signed by both Parties.
EXECUTION. The Tutor and the Client each represent and warrant to the other that each person executing this Contract on behalf of each party is duly authorized to execute and deliver this Contract on behalf of that party.
